Overview of Bangladesh's Environmental Regulatory Framework

Environmental regulation in Bangladesh is overseen by the Ministry of Environment, Forest and Climate Change (MoEFCC) and its subordinate Department of Environment (DoE). The Environment Conservation Act (ECA, 1995, amended 2010) and the Environment Conservation Rules (ECR, 1997, amended 2023) form the core legal framework, and all manufacturing investments are required to obtain an Environmental Clearance (EC) before commencing operations.

The EIA Approval Process

Stages 1–2: Industry Classification and NOC Acquisition
Check the industry classification table in the ECR (Environment Conservation Rules) to determine the category for the intended investment — e.g., dyeing factory → Red; garments factory → Orange-A; IT → Green. Obtain a NOC (No Objection Certificate) from the relevant local authority (Union Parishad, Pourashava, or City Corporation). The NOC certifies the absence of community objections and typically takes 2–4 weeks.

Stage 3: Conducting the EIA / IEE
Red category industries require a full EIA (Environmental Impact Assessment); Orange category requires an IEE (Initial Environmental Examination). These must be conducted by a DoE-registered certified environmental consulting firm. Costs typically range from USD 10,000–30,000 for Red and USD 3,000–8,000 for Orange. EIA reports must include a Baseline Survey, environmental impact analysis, mitigation measures, and a monitoring plan.

Stages 4–5: Submission to DoE and Site Inspection
The EIA report and Environmental Clearance application are submitted to the DoE regional office. For Red category industries, a DoE environmental officer will visit the site to assess location suitability, wastewater treatment plans, and emission impacts. A Public Hearing may be required, which adds 2–4 weeks for community consultation.

Stage 6: EC Issuance and Renewal
Upon satisfying all conditions, the DoE issues an Environmental Clearance Certificate. Validity is 1 year for Red and 3 years for Orange categories; renewal requires submission of an environmental monitoring report. Operating without Environmental Clearance can result in factory closure, fines of up to BDT 10 million, and imprisonment of up to 2 years.
